TERMS OF SERVICE

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING KLIPZ, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Acceptance of Terms

By accessing or using Klipz ("the Service"), you agree to be bound by these Terms of Service. We reserve the right to modify these terms at any time by posting updated terms on this page. Continued use of the Service after any modification constitutes acceptance of the updated terms. Please check these Terms regularly.

2. Description of Service

Klipz is a web-based tool that allows users to clip and download segments of publicly available online videos. Processed files are stored temporarily and automatically deleted within 30 minutes. We do not host, store, or distribute any video content beyond this temporary processing window. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. Subscriptions and Pricing

Klipz Premium is offered as a monthly recurring subscription billed through our payment processor, Creem.io. By subscribing, you authorise Creem.io to charge your payment method on a monthly basis until you cancel.

  • Price changes: We reserve the right to change the subscription price at any time. We will provide at least 30 days' advance notice of any price increase by email to your registered address and/or by posting a notice on the Service. Continued use of the Premium subscription after the effective date of a price change constitutes acceptance of the new price. If you do not accept the new price, you may cancel your subscription before it takes effect.
  • Cancellation: You may cancel your subscription at any time through your Creem.io account settings or by contacting us at legal@klipz.app. Cancellation stops future charges; you retain Premium access until the end of your current billing period.
  • Refunds: Refunds are governed by our Refund Policy.

4. User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR USE OF THIS SERVICE COMPLIES WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS. Klipz is not responsible for any violation of applicable laws committed by you or at your direction. Specifically, your actions must not contravene the laws of (1) the country, state, or locality where you reside, or (2) the country where Klipz operates.

Those who access the Service do so at their own initiative and are solely responsible for compliance with their local and national laws.

5. User Warranties

By using the Service, you represent and warrant that:

  • All information you provide to Klipz is true, accurate, and up to date.
  • You have full power and authority to enter into these Terms of Service.
  • You are of legal age to form a binding contract in your jurisdiction.
  • You own the rights to the content you are clipping, or have explicit permission from the rights holder.
  • Your use of the Service does not infringe any copyright, trademark, or other intellectual property rights of any third party.
  • You will not use the Service to download, distribute, or reproduce copyrighted content without authorization.
  • Your use of the Service does not constitute defamation, libel, consumer fraud, or cause injury to any third party.
  • You will not promote violence, hate speech, or illegal activities through the Service.
  • You will perform all obligations under these Terms in accordance with applicable laws, rules, and regulations.

6. Prohibited Uses

You agree not to use the Service to:

  • Download, reproduce, or distribute copyrighted content without authorization from the rights holder.
  • Circumvent any digital rights management (DRM) or access controls.
  • Engage in commercial exploitation of downloaded content without proper licensing.
  • Upload or transmit viruses or any other harmful, disruptive, or destructive files.
  • Interfere with or disrupt the Service, its servers, or any networks connected to it.
  • Attempt to gain unauthorized access to any part of the Service, its systems, or other users' data.
  • Access the Service through automated means or bots without authorization.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Use the Service in any way that could damage, disable, overburden, or impair it.

ANY ATTEMPT TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF KLIPZ IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. KLIPZ RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH USER TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Intellectual Property

Klipz does not claim ownership over any content processed through the Service. All intellectual property rights in third-party content remain with their respective owners. Klipz disclaims any proprietary interest in third-party intellectual property. The Klipz name, logo, and interface are the property of Klipz and may not be used without prior written permission. You agree not to copy, republish, reverse engineer, or create derivative works based on the Service or its content.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. NO ADVICE OR INFORMATION OBTAINED FROM KLIPZ SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

9. Limitation of Liability

IN NO EVENT SHALL KLIPZ OR ITS OPERATORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, REVENUE, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ANY ACTION BROUGHT AGAINST KLIPZ MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE DATE THE CAUSE FOR ACTION AROSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS, SO THE ABOVE MAY NOT APPLY TO YOU IN FULL.

10. Indemnification

You agree to indemnify and hold harmless Klipz, its operators, affiliates, officers, and agents from any expense, loss, claim, damage, fine, penalty, or liability — including reasonable attorneys' fees — arising out of or related to: (1) your breach of these Terms of Service; (2) your use or misuse of the Service; (3) your violation of any applicable law or regulation; or (4) any claim by a third party that your use of the Service infringes their rights.

11. DMCA / Copyright Infringement

Klipz respects intellectual property rights and responds to valid notices of alleged copyright infringement. If you believe that content processed through our Service infringes your copyright, please contact us at:

Your notice must include: (1) identification of the copyrighted work; (2) identification of the infringing material and its location; (3) your contact information; (4) a statement of good faith belief that the use is unauthorized; (5) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner; and (6) your physical or electronic signature.

12. Termination

These Terms remain in effect until terminated. We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice and without liability. These Terms will terminate automatically if you fail to comply with any provision herein. Upon termination, you must immediately cease all use of the Service.

13. Force Majeure

Klipz will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, network failures, server outages, third-party service disruptions, or governmental actions. Temporary suspension of the Service may occur without notice at our discretion for maintenance, repair, or reasons beyond our control.

14. Injunctive Relief

You acknowledge that any violation or breach of these Terms may cause Klipz immediate and irreparable harm. As a result, Klipz has the right to seek preliminary and permanent injunctive relief, in addition to any other remedies available at law or in equity, without the requirement of posting a bond or other security.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be interpreted or reformed to the minimum extent necessary to make it enforceable. The invalidity of any single provision shall not affect the validity or enforceability of the remaining provisions.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Klipz does not represent that the Service is appropriate or available in all locations. Those who access the Service from other locations do so at their own initiative and are responsible for compliance with their local laws.
